The site accessible at the following URL www.praeconis.fr is operated in compliance with French law. The use of this site is governed by these general terms of use. By using the site, the user acknowledges having read these conditions and accepts them. Praeconis reserves the right to modify or update these legal notices at any time and without notice. 4. Description of services provided

Praeconis currently provides its broker users with a set of online services, including :

  • Access to their "products" library, which includes various membership, risk selection, and commercial documents
  • "Flash" pricing
  • Online customization, editing, registration, consultation, and modification of personalized quotes
  • Direct issuance or via generated quotes of membership requests,
  • Statistics on their extranet site usage.

Praeconis offers users in the "member" area the ability to :

  • Consult certain information regarding the subscribed guarantee (premiums, guarantee details, quotes and reimbursements, simulations of refunds, letters, attestations, and certificates),
  • Consult the latest payments made (monthly statements, breakdowns),
  • Download the third-party payment card,
  • Consult the list of partner healthcare professionals,
  • Consult various useful information (FAQ).

Unless expressly stated otherwise, any new feature that improves, modifies, or removes one or more existing services, or any new service launched by Praeconis, will be subject to these general terms of use.

4.1 Access to the site by co-brokers

The broker may request the registration of one or more co-brokers so that they can access, under the sole responsibility of the holder (the broker), all or part of the Service to which the latter has access. The co-broker will be deemed to have read and accepted these general terms of use.

4.2 Access management and passwords

The site is available on access code and password provided by Praeconis.

Access codes and passwords are strictly personal and confidential.

The user takes all measures to ensure the security and confidentiality of their password. They are responsible for the conservation, confidentiality, and use of their identifier and password.

The user is also responsible for the consequences of disclosing their identifiers and passwords, even unintentionally, to any person, and Praeconis shall not be held responsible for the consequences that would result from fraudulent or abusive use of identifiers and passwords.

The user also agrees to report to Praeconis as soon as possible any fraudulent use of their identifier or password.

The user may modify the passwords that were initially assigned to them at any time via the site.

Praeconis reserves the right to suspend the user's access to the site in case of fraudulent use or attempted fraudulent use of this access. In the event of access suspension, Praeconis will inform the user immediately.

4.3 Duration - Termination

The duration of the availability of the service assure-en-ligne.fr corresponds to the duration agreed upon in the brokerage agreement signed between the broker and Praeconis.

The user acknowledges Praeconis' right to terminate all or part of the access rights corresponding to the username and password, or to delete them, as well as the right to remove or relocate any content on the service if Praeconis has good reason to believe that the user has violated or acted in contradiction with the letter or spirit of these General Terms and Conditions of Use.

5. Protection of Personal Data

We undertake to protect the user's personal data. They are confidential and will not be communicated to third parties except for the proper execution of the service.

No personal information is collected without the user's knowledge.

In the course of using the website, personal data (location, login and usage data) may be collected to :

  • provide the user with statistics on the use of their account,
  • use these statistics to always better adapt our site to the needs of the user.

In accordance with the French Data Protection Act "Informatique et Libertés" n° 78-17 of January 6, 1978 amended in 2018 following the entry into force of Regulation (EU) 2016/679 of April 27, 2016 (GDPR), the user has the right to access, rectify, delete, transfer and object to the processing of their personal data for legitimate reasons, to define instructions on the fate of their data after their death, as well as a right to limit processing.

  • Personal Data concerning members (clients)

The personal information of clients that the user transmits to register their quotes is collected only for the sole purpose of facilitating the subscription of contracts by their clients.

This information cannot be used by the user for any other purpose and is not used by Praeconis for any other purpose.

The data will be kept for the time necessary for these different operations, or for the duration specifically provided for by the CNIL (standards for the insurance sector) or the law (legal requirements). They are also subject to regular purges.

In case of a complaint, users may choose to contact the DPO or the CNIL.

6. Cookies

8. Service Quality and Limitation of Liability Clause

Praeconis strives to allow access to its online services 24 hours a day, 7 days a week, except in cases of force majeure or events beyond the control of Praeconis and subject to possible outages and maintenance interventions necessary for the proper functioning of the website www.praeconis.fr and/or online services.

Praeconis may interrupt the site for maintenance reasons. This interruption will be notified by means of a warning displayed on the homepage or by any other means. This interruption cannot under any circumstances engage the liability of Praeconis and does not entitle to any compensation.

Praeconis cannot be held liable for any reason, and without limitation, in the event of modification, suspension or interruption of the site.

Praeconis does not guarantee that the service will perfectly meet the user's expectations, that the service will be uninterrupted, timely, secure or error-free, that the results that may be obtained using the service will always be accurate and reliable, and that any defects in the software used, if any, will be corrected.

9. Legal basis and dispute resolution

These General Terms and Conditions of Use and the relationship between Praeconis and users are subject to French law.

Prior to any legal action related to or in connection with these General Terms and Conditions of Use, the parties agree to seek an amicable solution.

Any dispute arising from the execution, non-execution, or interpretation of this document that cannot be settled amicably will be submitted to the competent courts having jurisdiction over the registered office of Praeconis, unless there are provisions of public order to the contrary.

These General Terms and Conditions of Use of the Service constitute the entire agreement between Praeconis and the subscriber of the Service regarding the use of the Service, and replace any agreement that may have been entered into previously between users and Praeconis in the field of the Extranet.

The failure of Praeconis to exercise the rights granted to it under these provisions shall not be construed as a waiver of those rights.

In the event that any provision of these General Terms and Conditions of Use is declared invalid by a court decision, the parties agree that the other provisions shall remain valid and continue to apply in accordance with the common intention of the parties.
